Consent to Telehealth

JBH Clinic LLC provides online platforms (the “Services”) that connect you with independent, licensed health care professionals in your area for virtual consultations. If medically appropriate, you may also choose to receive prescription medications through associated mail-order pharmacy services. Within the United States, these Services are considered a form of telehealth, meaning health care is delivered through electronic communication tools between a patient and a provider who are not physically together. Telehealth may be used for diagnosis, treatment, follow-up, and/or patient education. For clarity, “telehealth” involves synchronous (real-time) or asynchronous (delayed) communication to evaluate, diagnose, consult, treat, and monitor a patient, transfer medical data, and provide health-related education or administrative services. It does not include audio-only phone calls, standard email, or fax transmissions.

  • Electronic transmission of medical records, photos, personal health information, and other data between you and a provider.
  • Virtual interactions via audio, video, and/or asynchronous channels (e.g., secure messaging, email).
  • Use of data from remote monitoring devices, medical instruments, and audio or video files.
  • Our websites and the information systems that support these Services incorporate security measures designed to protect the confidentiality and integrity of your health information.

Potential Benefits of Telehealth

  • Convenient access to medical care with potentially less time and cost.
  • Flexible scheduling that may better accommodate your availability.
  • Appropriate evaluations where a telehealth provider can assess your needs, and in some cases may not require a physical exam before offering diagnosis or treatment.

Potential Limitations of Telehealth

  • Insufficient information: The data you provide may be inadequate for a proper medical assessment, or your provider may determine your condition is not suitable for telehealth, requiring in-person care.
  • Lack of in-person tests: Certain examinations, tests, or vital sign checks cannot be done remotely, which may affect diagnosis or treatment.
  • Technology failures: Service disruptions or technical problems may delay or interrupt your care.
  • Data security risks: Though safeguards are in place, electronic communications carry a risk of data breaches or unauthorized disclosures.
  • Legal and regulatory constraints: Depending on your location, certain treatments or prescriptions may not be available via telehealth.

By selecting “Agree,” you confirm your understanding and acceptance of the following:

  • Emergency Care: Telehealth services are not intended for emergencies. If you need emergency care, call 9-1-1 or go to the nearest emergency facility.
  • Consent to Treatment: You consent to receiving medical care and treatment through telehealth from licensed providers (“Providers”).
  • Evolving Field: You understand telehealth is continually developing, and the technologies used may vary from what is specifically described here.
  • Technical Failures: You acknowledge that technical issues (e.g., loss of data or connection) can occur, potentially causing delays or loss of information. In line with the Terms of Use, you agree to hold JBH Clinic LLC harmless for such events.
  • No Guarantees: While telehealth can be beneficial, outcomes are not assured. Your condition may not improve and could worsen.
  • Patient Responsibility: You agree to provide truthful and thorough information about your health and medical history. Failure to do so may lead to harm, including serious complications.
  • Access to Records: You can access your telehealth records as permitted by law.
  • Provider Discretion: Your provider may decide telehealth is not right for your condition and recommend in-person care. Telehealth does not replace existing patient-provider relationships.
  • Privacy and Sharing: You understand your data will be collected, used, and shared as described in the Privacy Policy and for any lawful purposes, such as treatment, payment, or health care operations.
  • Sharing Records: If applicable, and at your request, your telehealth records may be shared with your other health care providers.
  • Right to Withdraw: You can withdraw consent at any time by emailing JBH Clinic at [email protected]. Otherwise, this consent renews with each new telehealth consultation.

By proceeding, you confirm you have read, understood, and agree to the information in this Consent to Telehealth, including the collection, use, and sharing of your information under the Privacy Policy and as allowed by law. All capitalized terms used but not defined in this document carry the meanings set forth in our Terms of Use and/or Privacy Policy.
